By installing, accessing, or using Erin Gradient Countdown Timer (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Erin Gradient Countdown Timer is a Shopify application that allows merchants to create and display customizable countdown timers on their online stores. The App provides features including:

• Creation and management of countdown timers
• Customization of colors, fonts, and gradient backgrounds
• Display unit selection (days, hours, minutes, seconds)
• Positioning options (top/bottom)
• 12 preset gradient background templates

3. Account and Registration

To use the App, you must have a valid Shopify store and account. You are responsible for:

• Maintaining the security of your Shopify account
• All activities that occur under your account
• Ensuring your use complies with Shopify's Terms of Service

4. Subscription and Billing

4.1 Pricing Plans

We offer multiple subscription plans with different features and pricing. Current plans include:

• Free Plan: $0/month
• Starter Plan: $9.90/month or $95/year
• Essential Plan: $99/month or $950/year
• Ultimate Plan: $239/month or $2294/year

4.2 Payment Terms

• All fees are charged through Shopify's billing system
• Subscriptions automatically renew unless cancelled
• Prices are subject to change with 30 days notice
• No refunds for partial months or unused features

4.3 Cancellation

You may cancel your subscription at any time through the Shopify admin. Upon cancellation, you will retain access until the end of your current billing period.

5. Acceptable Use

You agree not to use the App to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Display misleading, fraudulent, or deceptive content
• Distribute malware or harmful code
• Interfere with the App's operation or security
• Attempt to reverse engineer or copy the App

6. Intellectual Property

The App and all related materials are owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your business purposes only.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy. We collect and process data as described in the Privacy Policy, which is incorporated into these Terms by reference.

8. Warranties and Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be:

• Uninterrupted or error-free
• Free from viruses or harmful components
• Compatible with all systems or browsers
• Meeting your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you display through the App

11. Modifications to Service

We reserve the right to:

• Modify or discontinue the App at any time
• Change features or functionality
• Update these Terms with notice
• Suspend or terminate accounts for violations

12. Termination

We may terminate or suspend your access to the App immediately, without notice, for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• At our sole discretion

Upon termination, your right to use the App ceases immediately, and we may delete your data after 30 days.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.
